Shooting suspect withdraws guilty plea

SCHENECTADY -- A suspect in a deadly shooting near a Schenectady school tried to withdraw his guilty plea on Friday.

Nicholas Kahan previously pleaded guilty to killing William Riddick near Mont Pleasant Middle School last November. A judge told Khan on Friday that his change of plea would have to be reviewed before it could be accepted.

The Assistant District Attorney in the case says that may not happen. "It is not usual for someone who has made a very serious, life-altering decision to have second thoughts about it," says ADA Philip Mueller. "But except in extraordinary cases, which aren't present here, the decision to plead guilty under oath is a final one."

Khan is scheduled to be back in court in September with a new attorney.
